Abstract

Die Klausuraufgabe aus dem Strafrecht für die Erste Juristische Staatsprüfung behandelt zum einen Fragen der Rechtfertigung und der Irrtumslehre, eingekleidet in die Prüfung von Körperverletzungs- und Tötungsdelikten. Zum anderen stellt sie die Anforderung an den Prüfling, eher entlegene Tatbestände in das Rechtsgutachten einzubeziehen. Am Ende der Arbeit werden Fragen des Beweisrechts behandelt. This mock-examination paper in criminal law for the First State Examination in Law concerns issues of justification and the doctrine of mistake of fact within the scrutiny of offences of bodily harm and those against life on the one hand. On the other hand the paper challenges the candidate to cover more remote offences as well. In the end, the paper deals with aspects of the law of criminal evidence.
